What is the new hit-and-run law?
The new law is part of the The Bharatiya Nyaya Sanhita (BNS). It replaces the old Indian Penal Code from the British times. According to this new law, if a driver causes a serious accident because they were driving carelessly, and then they run away without telling the police, they could go to jail for up to 10 years and pay a fine of Rs 7 lakh.
What was the old hit-and-run law?
Before this new law, there wasn’t a special rule for hit-and-run cases. Instead, the actions in such situations were decided by Section 304 A of the IPC. According to this section, if someone causes another person’s death because of being reckless or careless, they could go to jail for a maximum of two years or pay a fine.
Why are truck drivers upset about the new law?
The main problem people have with the new law is the strict punishment for leaving the accident spot. Earlier, the punishment was much lighter, only two years in jail and a smaller fine. Truck drivers worry this puts them in danger, even if the accident wasn’t completely their fault. They also fear violence from groups of people, especially in rural areas, when they try to take injured people to hospitals.
